User status

The use of the Website confers the status of User of the Website and implies adherence to the present conditions in the version published at the time of access and use.

By placing an order on the Website, the User acquires the status of Customer, whether registered or not. The User also declares that they are aware that we sell products to non-wholesale Customers acting in their capacity as consumers.

The User also represents and warrants that they are (i) legally capable of entering into binding contracts, (ii) of legal age for these purposes and (iii) acting in their capacity as a customer.

The Website is intended exclusively for persons of legal age, and therefore any person under the legal age must refrain from using any of the services available through the Website, including the web forms, or from registering as a user or making purchases.

In the event that the User does not understand or does not accept the T&C, they must cease using this Website.

User's personal account

The user (hereinafter, the User) can register on the Website by filling in a series of personal data and choosing an access password, which will be used for future purchases made on our website.

The login credentials (e-mail address and password) are strictly personal, and the User agrees to keep their password confidential and not share it with third parties. In the event that the User becomes aware that an unauthorized third party has used their account, the User agrees to change their password without delay and to immediately inform HD COSMETIC EFFICIENCY.

Cancelling the User's account:
The User may freely close his account at any time and without notice. In case of orders in progress, the closure of the account will be effective at the end of the withdrawal period.

HD COSMETIC EFFICIENCY may cancel the account of a User, if the User fails to comply with these T&Cs. In such a case HD COSMETIC EFFICIENCY will inform the User by an email detailing the reasons for the closing and the date of termination of the account.

In that event, the User is invited to download the information and invoices relating to his/her order history in order to keep a local and durable copy. The User retains the right to file a complaint and to assert legal guarantees.

HD COSMETIC EFFICIENCY provides the services and offers for sale the products listed on the Web Site, with the specified particular conditions of each product, a description of its features, purchase or subscription options for that product with their respective prices in U.S. dollars, existing financing conditions and mode of use.

The prices are those indicated on the Website at the time of placing the order, which the User will have the option to review before confirming the order. The User acknowledges that HD COSMETIC EFFICIENCY may revise the prices of the Products and Services on the Website from time to time.

HD COSMETIC EFFICIENCY can offer through the Web Site, services or promotional actions with temporary character that will be submitted, in its case, to its own particular conditions, which will be made known to the Users in each specific case and will prevail with respect to the established in the T&C. If the conditions of the promotion do not address any issue in question, the provisions of the T&C shall apply. In case of discrepancy between them, the aforementioned particular conditions shall apply. HD COSMETIC EFFICIENCY reserves the right to change the terms and conditions of any of the promotional campaigns without notice. The Customer may review the price actually paid for a product for previous orders through the confirmation email received, the sales receipt sent in the package, or in the Customer's account if the Customer was registered on the Website at the time the order was placed.

The price of the product displayed does not include the delivery costs of the order. The delivery costs will be calculated and expressed on the order summary page, prior to confirmation and payment by the User and shipment of the order.

To make a purchase, the User must follow the following process:

- The User must select the product(s) on the website that they wish to purchase.
- Once the User has selected the products they wish to purchase, the User must click on the "Add to Cart" button, and the Product(s) will be added to the cart. At any moment it will be able to consult the articles added to the basket clicking on the icon of the basket in the top right part of the Web site.
- Once the selection of the Products has been completed, a summary of those selected will appear. To continue, the User must click on the "CHECKOUT" button, which will allow them to verify the shopping cart, delete Products and correct any errors in the data entry. After validating the shopping cart to place the order, the User must choose the payment method and click on "PAY NOW".
- The User must identify themselves with their account information or complete the registration form.
- Once the order process is completed, the User will receive an email confirming the purchase.
- After the confirmation of the shipment, the User will receive an email from the transport company with the tracking of his order.

The User may use a coupon. These codes are valid for all Products offered for sale on the Platform until their expiration date. Unless otherwise stated in the description of the codes, (i) the codes are not cumulative with each other, (ii) the codes are not usable on shipping costs, (iii) the codes are not exchangeable or refundable (i.e. in case of refund of the order paid with a code, the code is permanently lost), (iv) codes with monetary value are usable only once and only for an order for a total amount greater than the value of the code, (v) codes are not usable for an order already validated, and (vi) codes cannot be converted into currency or transferred to a bank account.

HD COSMETIC EFFICIENCY is not liable for the inaccuracy of the information provided by the User through the purchase procedure. In general, HD COSMETIC EFFICIENCY has the right to refuse any order for products of an unusual nature, in particular, in the case of orders in quantity and/or for quantities that would reasonably be considered unusual by HD COSMETIC EFFICIENCY or if it violates these T&Cs.

An "order" is only considered placed when a User submits it through our online checkout process.

HD COSMETIC EFFICIENCY will send the Customer an email notification to the email address provided by the Customer upon acceptance of the Customer's order. At that moment, the purchase contract will be formalized and will become binding both for the User, already a Customer, and for HD COSMETIC EFFICIENCY, as long as the order is paid correctly.

After the User's confirmation of the order, once it is sent, the User cannot modify it, although they may use their right of withdrawal if appropriate.

The payment of the order will be made at the end of the purchase process and will be an essential condition to formalize the order correctly.

Payment can be made by credit card (Visa, MasterCard, etc.), Google Pay, Apple Pay, through PayPal or Stripe platforms.

As a general rule, all payments must be made in US dollars.

HD COSMETIC EFFICIENCY, through the Website, only ship products throughout the United States.
Consequently, orders will only be shipped to addresses within the territories mentioned.
The products will be shipped to the address indicated by the Customer when placing the order and, failing that, to the address stated in the Customer's account.
Shipping times are 2-10 days, these times are approximate. These times are calculated on business days - Monday through Friday - because HD COSMETIC EFFICIENCY does not ship on holidays, Saturdays or Sundays. In periods of promotions, sales and sales peaks, the waiting time may be longer. But we will always try to speed up the process to ensure the shortest delivery time.
HD COSMETIC EFFICIENCY will make every effort to deliver the products to the Customer as soon as possible and in accordance with the delivery option selected by the Customer.
HD COSMETIC EFFICIENCY is not responsible for any delay in transportation caused by:
- Incorrect or incomplete address.
- Failure to provide a contact telephone number.
- Strikes by our logistics providers.
- Customs clearance processes of any territory.
- Adverse weather conditions, force majeure circumstances or any other cause beyond its control.
The Customer must check at the time of ordering that the address is correct and assumes any delay in delivery, return of products, additional costs or other possible consequences arising from any incorrect or incomplete indication.
At the time of delivery, the Customer must check the condition of the products in the presence of the carrier and report all necessary reservations about apparent defects (missing product, damaged package, incomplete delivery). If the Customer does not notice any external breakage in the package when receiving it, but when opening it, they notice damage due to transport, it is advisable to notify the transport company within 24 hours to record it and contact HD COSMETIC EFFICIENCY. Otherwise, it will be understood that the product has been accepted in conformity.
Once this period has passed, the transport company will consider that the material sent is in perfect condition and will not be responsible for any damage.

Shipping is free for all orders over $70 throughout the United States. For orders over 70$ the shipping costs are included in the order.
For purchases of less than $70, shipping costs are the responsibility of the User. The shipping cost will be detailed before finalizing the order.
HD COSMETIC EFFICIENCY works with a logistics provider located in Texas that does all shipping.

The Customer has the right to withdraw their order, without justification, within fourteen (14) calendar days from the day of receipt of the order. Once the 14 days have elapsed, it will not be possible to exercise the right of withdrawal.
In order to request a return, the User must provide the following information within 14 days from the date of receipt of the order:
- Date of receipt of the order and order number.
- Name of the product, quantity you wish to return.
- Reason for the return with images of the state of the product.
HD COSMETIC EFFICIENCY ’s customer service team will process the information received and will contact the customer and send them a prepaid return label to be placed on the shipping package.
The Customer must prepare the products in a box together with the original invoice, place the prepaid label and take the package to any courier delivery location shown on our prepaid label.
The User must bear the direct cost of returning the goods. In all cases, the Products to be returned must be in the same condition, in their original box/packaging and with the manuals, accessories or promotional gifts, if any, included. If this is not the case, the withdrawal cannot be exercised. The return of Products without the seal or if it has been tampered with will not be accepted.
The corresponding department of HD COSMETIC EFFICIENCY will verify that everything is correct and in perfect condition, authorizing the refund to the corresponding department and will communicate it to the User via email. Refund requests will be considered on a case-by-case basis. We reserve the right, at our reasonable discretion, to refuse to refund or exchange any product.
When the return is processed, we will proceed to make the refund, if applicable, with the same payment method with which you purchased the Products and within a maximum period that will depend on the bank with which you made the payment.
If the quality control upon receipt of the Product detects that it has been opened or tampered with, the return will not be accepted. In this case, at the User's request and according to his/her preference, HD COSMETIC EFFICIENCY will send back to the User the Product whose return has not been accepted - at the User's expense - or, alternatively, the User may pick up the Product at HD COSMETIC EFFICIENCY's premises.
HD COSMETIC EFFICIENCY will not make any refund if the returned products do not correspond to the products of the corresponding order.
It is not possible to exchange or receive a refund for products purchased in Med Spas marketed by our brand through the Website. The User is recommended to contact directly the point of sale where the purchase was made.
Notwithstanding the foregoing, unless HD COSMETIC EFFICIENCY has offered to pick up the returned products itself, HD COSMETIC EFFICIENCY may withhold reimbursement until such time as either, (i) it receives the products returned by the Customer (ii) the Customer provides sufficient proof of shipment of the products.

The legal warranty of conformity applies when the product presents a lack of conformity, for example, when it does not work according to the usual uses, or when it does not correspond to the description given.
The warranty period for the products is [INDICATE TERM UNDER US LEGISLATIONS] from delivery, although deficiencies caused by negligence, blows, incorrect use or improper handling, or materials that are worn out by use, among others, are not included.
The warranty offered by HD COSMETIC EFFICIENCY shall be invalid if any of the following circumstances occur:
a) Blows and/or improper transportation.
b) Tampering with any identification/control seal or label.
c) Normal wear and tear.
In the event that the warranty is applicable, the Customer will obtain the replacement of the product. Alternatively, if replacement is not possible, the Customer may obtain a refund of the amount paid for the product.
The Customer is exempted from providing proof of the existence of the non-conformity of the product for two years after delivery of the product.
In order to make use of the warranty, the Customer must inform HD COSMETIC EFFICIENCY after receiving the product by sending an email to customerserviceusa@dermogalenicexperts.com. HD COSMETIC EFFICIENCY will contact the Customer to indicate the steps to follow.
The Customer shall pay the shipping costs until it is verified that the conditions of the product are not suitable, in which case the return costs will be refunded and, at the Customer's choice, HD COSMETIC EFFICIENCY will proceed with the shipment of a replacement product or with the reimbursement of the amount paid by the Customer in the initial purchase of the product. The refund will be made in the same payment method used for the initial purchase.
In case of cancellation of an order purchased in whole or in part with a gift voucher or any other type of promotion, the amount you finally paid will be refunded with the discount applied.

The User undertakes to use the Website, its contents and services in accordance with current legislation, good customs and public order, as well as in accordance with the provisions of these T&C. Likewise, the User undertakes to:

- Not to infringe Intellectual or Industrial Property rights belonging to HD COSMETIC EFFICIENCY or third parties;
- Not to reproduce or copy, distribute, transfer or allow public access through any form of public communication, transform or modify the contents of the Website, unless authorized by the owner of the corresponding rights or it is legally permitted;
- Not to remove, manipulate or in any way alter the marks of ownership of the content and reservation of rights of HD COSMETIC EFFICIENCY or third parties, or fingerprints or digital identifiers, or any other technical means established for the recognition of the content of the Website;
- To refrain from obtaining and even attempting to obtain the contents by using means or procedures other than those which, as the case may be, have been made available for this purpose or have been indicated for this purpose on the web pages where the contents are located.
- Not to destroy, alter, render useless or in any other way damage the contents found on the Website or introduce programs, viruses, macros or any other logical device or sequence of characters that cause or are likely to cause any type of alteration in the computer systems of HD COSMETIC EFFICIENCY or third parties.
- Refrain from using the contents or services included in the Website to carry out activities that may damage the image of HD COSMETIC EFFICIENCY.
The User shall be liable for damages of any nature that HD COSMETIC EFFICIENCY may suffer, directly or indirectly, as a result of the breach of any of the obligations under these conditions or the law in connection with the use of the Website.
HD COSMETIC EFFICIENCY has the right to deny at its discretion, at any time and without prior notice, the access of any user to this page or any part of it, when the duty of correct use of the Website is not fulfilled.
HD COSMETIC EFFICIENCY shall be entitled to interrupt or remove, at its sole discretion, the contents or exclude the User from the Website in case of alleged commission of any crime, or in case of observing any conduct that in the opinion of HD COSMETIC EFFICIENCY, are contrary to morality, public order, good customs or the rules of this Website, or that may disrupt the proper functioning, image, credibility or prestige of HD COSMETIC EFFICIENCY or its collaborators.

The Intellectual Property rights that fall on the contents shown and offered on the page are the exclusive property of HD COSMETIC EFFICIENCY except in cases where a different ownership is indicated, in which case they will belong to the third party mentioned. HD COSMETIC EFFICIENCY guarantees that the content protected under this type of rights is lawful and complies with current legislation. None of the exploitation rights or any other rights that exist or may exist on said contents beyond what is strictly necessary for the correct use of the Website may be understood as assigned to the User by virtue of what is established in this T&C. The User undertakes to respect the intellectual property rights of HD COSMETIC EFFICIENCY or any other third party that may apply to the contents displayed on the website.
The Industrial Property rights that fall on the trademarks, trade names or designs contained in the page are also the exclusive property of HD COSMETIC EFFICIENCY. The User undertakes to respect the Industrial Property rights of HD COSMETIC EFFICIENCY and of any other third party that may apply to the contents of the Website. The use or the granting of access to the Website does not imply the granting of any right over the trademarks, trade names or any other distinctive sign used therein.
Any contravention of the provisions of this clause may be considered an infringement of intellectual property rights and may, therefore, be prosecuted by the civil and administrative means provided for that purpose by the legislation in force.

Access to the Web Site is technically possible 24 (twenty-four) hours a day and 7 (seven) days a week.
HD COSMETIC EFFICIENCY has the right to interrupt access to its Web Site, as well as the provision of any or all of the contents provided through the same at any time and without prior notice, whether for technical, security, control, maintenance, power failure or any other cause.
On the other hand, HD COSMETIC EFFICIENCY does not guarantee the reliability, availability or continuity of its Website or its content, so that the use of the same by the User is carried out at his own risk, without, at any time, can be held liable to HD COSMETIC EFFICIENCY in this regard.
HD COSMETIC EFFICIENCY is not liable for the use that the User makes of the services and products of the Website or its passwords, as well as any other material of the Website, infringing the intellectual or industrial property rights or any other right of third parties. Likewise, HD COSMETIC EFFICIENCY excludes any liability for damages of any kind that may be due to the presence of viruses, computer threats or other harmful elements in the contents that may cause alterations in the computer systems, as well as in the documents or systems stored by HD COSMETIC EFFICIENCY.

HD COSMETIC EFFICIENCY may terminate or suspend at any time and without prior notice the provision of the services of the Website to those Users who breach the provisions of these T&C.

When the User provides personal data through the different web forms on the Website, they undertake to provide truthful and current information of their own. Users must not provide personal information of third parties without being authorized to do so.
If necessary, Users may modify some of their personal data by accessing their account. In this sense, the User undertakes to keep their account updated and with accurate information.
The User's personal data are processed by HD COSMETIC EFFICIENCY in accordance with the policies linked below:

If any provision of the T&C is or becomes illegal, void or unenforceable, such provision shall not affect the validity and enforceability of the remaining provisions.
The failure of HD COSMETIC EFFICIENCY to exercise or enforce any right or remedy under these T&C shall not constitute a waiver of such right or remedy. These T&C contain the entire agreement between HD COSMETIC EFFICIENCY and you as User and, if applicable, Customer and may only be modified by a writing signed by both parties.

The T&C are governed and interpreted in accordance with the US legislations in force, as well as the relations between HD COSMETIC EFFICIENCY and the User derived from the use of the Website. By using the Website, the User agrees that the applicable federal and Texas state law, without regard to conflict of law principles, will govern these T&C and any dispute of any sort that might arise between you and HD COSMETIC EFFICIENCY.

HD COSMETIC EFFICIENCY has the right to modify, at any time, the presentation and configuration of the Website, as well as to develop or update these T&C at any time, so the User should read them periodically.
